These General Conditions of Sale govern the sale of the products presented on the GANGE website between CARA and a consumer (the Customer).
The use of the site and the purchases of products offered on the site are subject to these Terms and Conditions. Any purchase on the site constitutes on the part of the Customer an unconditional acceptance of the General Conditions of Sale.
The Customer acknowledges having read it at the time of placing the order, and expressly declares to accept them without reservation.
CARA gives itself the possibility of modifying the GSC at any time without having to inform the Customer. In case of modification of the GTC, it will be applied to each order the General Conditions of Sale in force on the day of the order.
To place an order on the Site, the Customer must be of legal age, have the legal capacity and hold a credit card.
The photographs illustrating the products do not enter the contractual field. If errors are introduced, in no case the responsibility of the company CARA can not be committed. The company CARA reserves the right without notice to make any modifications to its products without obligation to modify the products previously delivered or in the course of order. During the validation of the order, all available products will be invoiced and debited. In the case of unavailable products, an email will be sent to you by proposing you either to partially cancel the order for these products, or to exchange it for another item of the same amount, or to accept a manufacturing period specified by written.
CARA incurs no liability in case of out of stock or unavailability of products.
The products are invoiced on the basis of the tariffs posted on the site at the time of the placing of the order. The CARA company reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in force at the time of the recording of the orders, subject to availability.
The products remain the property of CARA until the perfect payment of the price.
The prices of our products are indicated in Euros all inclusive of tax. If VAT rate had suddenly changed, the price of the articles would be modified consequently. These prices get along except transport costs and customs clearance charges (for the deliveries out of France), the latter remainder with the load of the Customer. In the event of order towards a country other than the Metropolitan France, the price of the products will be calculated net of tax on the invoice for the products except C.E.E and with VAT for the countries of E.E.C. Of the customs duties or other taxes are likely to be exigible. These rights and sums do not concern company CARA. They will be the responsibility of the Customer and raise of his whole responsibility as well in terms for declarations as for payments at the authorities and/or qualified organizations for its country. We advise with our customers to get information about these aspects near its local authorities. All the orders are payable in Euros.
The finalization of the order requires the creation of an own account on Site GANGE. It will be requested from the Customer to create his own password for a later use of this account. These logins are confidential and must never be communicated to thirds. Consequently, any purchase carried out by means of these logins will be famous to be carried out by the titular Customer of these logins. In the event of loss, of flight or any fraudulent use of his password, the Customer commits himself informing Site GANGE immediately of it.
During the placing of order the Customer must check the exhaustiveness and the conformity of the information which it provides to CARA. The latter could not be held responsible for possible errors of seizure and the consequences in terms of delays or errors of delivery. In this context, all the expenses engaged for the reforwarding will be the responsibility of the Customer.
CARA reserves the right not to accept an ordering of a Customer in the following cases:
- Case of litigation for a former order,
- Case of non-payment total or partial of a previous order by the Purchaser
- Case of refusal of authorization of credit card payment of the banking organizations,
- Case of non-payment or partial payment.
- Finally if CARA estimates that this Customer infringed the present General terms of Sales or that it engaged in a fraudulent activity, its order can be refused.
CARA's responsibility will not be able, in no case, to be committed.
The Customer can, via his clients' account, to get information about his orders placed, to manage and record information relating to it (addresses postal, telephone, contact banking).
The amount which had by the Customer is indicated before the validation of the order by the User, like on the confirmation of order transmitted by e-mail by CARA to the Purchaser.
All the orders are payable in Euros. To regulate his order, the Customer has the choice between several methods of payment.
The payment will be carried out, except unavailability of the waiter,
- Immediately on Internet, by purchasing card emitted in France or purchasing card emitted abroad by Credit card Aimed and Mastercard.
- By credit transfer (bank account number provided on request), on CARA. The user will have to then transfer of the amount indicated in the summary of order. CARA will proceed to the setting in forwarding of the order only when it receives on its account the transfer of Customer.
- By Paypal
The order will be regarded as valid after confirmation of the banking agreement of payment. In the event of refusal of the bank, the order will be automatically cancelled.
In any event, CARA reserves the right to refuse any order or any delivery in case:
- of existing litigation with the Customer,
- of non-payment total or partial of a previous order by the Customer,
- of refusal of authorization of credit card payment of the banking organizations,
- of non-payment or partial payment.
Our site is the subject of a security system. This service incorporates the SSL security standard. Confidential data (16-digit bank card number, expiration date) is transmitted encrypted (encrypted) directly to the bank server. Any order will be validated only after acceptance of the transaction by the "G.I.E. Bank cards ".
Products will be delivered to the delivery address you specified during the ordering process. This address will also be the billing address. You can also ask to be charged to another address by clicking in the box provided for this purpose.

For the deliveries out of the Metropolitan France the Customer commits himself regulating all the taxes due to the product imports, customs duties, tax on the added-value, and all other taxes due under the terms of the laws of the country of reception of the order. CARA is released in fact of any legal responsibility if the payment of the taxes were not carried out by the Customer.
For the deliveries in Colissimo ensured by the Post office in France, if the recipient is absent at the time of the passage of the Carrier, the parcel is deposited at a post office near the address of delivery. The not claimed parcels are turned over to CARA which declines any responsibility for the delays of delivery caused by the absence for the recipient for the parcel or in the event of absence for withdrawal within the time envisaged for this purpose.
CARA could not be held for person in charge of delays of delivery because of errors or ascribable disturbances with the Carriers (all-out strike or partial of the Carrier and/or the means of transport and/or communication).
CARA's commitment for the delivery periods is worth only subject to one perfect and clear formulation of its address by the Customer, its presence or that of a person entitled at the time of the passage of the carrier and the absence of any obstacle, imponderable or of any major force independent of the will of CARA and its conveying partner.
The goods always travel to the risks and dangers of the recipient. The delivery is regarded as realized as of the date of the first presentation of the goods to the purchaser. The Customer has as an obligation to check the conformity of the goods delivered at the time of the delivery, before signing the delivery order. Any anomaly concerning the delivery (damages, produced missing compared to the delivery order, damaged parcel, deteriorated products…) will have to be imperatively indicated on the delivery order, accompanied by the signature of the Customer. The Customer will have in parallel to confirm this anomaly by addressing to the carrier in the 48 hours following the delivery date a mail recommended with acknowledgement of delivery exposing the aforementioned claims. The contact of the carrier will be reproduced on the delivery order. In the same way, the Customer will have to inform CARA by e-mail or mail recommended, of these anomalies. At the end of this period, no claim could be accepted as for a defect or an apparent lack of the delivered article. If the Customer entrusts the reception of the product to an agent this one receives the parcel in the name of the Customer and for his account. The Customer must ask his agent to be vigilant on the follow-up of the precautions of use and to recall him to take to the received thing the same care that if he were personally recipient. Within the framework of a delivery carried out by the Post office, if the parcel arrives open and/or damaged (in particular with the presence of the yellow Scotch tape “La Poste “) the Customer can either accept it or to refuse it. If the Customer, or its agent, decides to accept the goods, it must be attentive with:
- To register “handwritten reserves” sufficiently precise while making sign the factor at side,
- To in parallel fill a “statement of anomaly” as the regulation of the Post office applies it.

If the Customer or his agent prefers to refuse the goods, besides the “handwritten reserves” to emit, it will have to ask the carrier whom the parcel is returned to CARA, is accompanied by a “report of spoliation”. In the event of delay of delivery by the Post office in the eight working days following the date of forwarding indicated in the email informing the Customer of the setting to the forwarding of its order, we suggest to him checking near its post office if the parcel is not in authority, then if necessary, we invite it to announce this delay by addressing an e-mail to us to contact.gange@fr.
We will contact the Post office then so that an investigation is open. This investigation of the Post office can last up to 21 working days as from its date of opening. So during this period, the product is found, it will be rebooked as soon as possible in the residence of the Customer. If on the other hand the product is still not localised at the conclusion of these 21 working days, the Post office will regard the parcel as lost.
To the fence for loss of the investigation, we will return to the Customer a substitute product (reference with our expenses). If the ordered products any more had not suddenly been available, the Customer will be able to obtain the refunding of the products concerned with the declaration of loss confirmed of the Post office.
In the event of delay of delivery by the other carriers in the five to ten working days following the date of forwarding mentioned in the email informing the Customer of the setting to the forwarding of the order, we invite the Customer to announce this delay by contacting our Customer service by e-mail.
We will open an investigation near the carrier concerned in order to obtain the localization of the parcel.
If the goods are found, it will be rebooked as soon as possible in the residence of the Customer. In the contrary case and after obtaining the report of loss declared by the carrier, we will reforward this/those product (s) or in the event of final unavailability, we will refund the Customer of the sums boxed according to the methods of these General terms of Sale.
Transfer of Responsibility
The goods always travel to the risks and dangers it Customer who must check the good state of the goods on arrival of the parcel. In the event of litigation or damage, it is up to the recipient to express the reservations justified in the presence of the carrier and to renew them to him under 48 H by registered letter with notice of receipt. The Customer must then immediately warn CARA by e-mail at the address: contact.gange@fr.
Delivery and manufacturing lead time.
Beware not to confuse delivery period and manufacturing lead time:
Manufacturing lead timedelay between the receipt of the order and the departure of the workshop. This period may vary according to the stocks of the product concerned.
Delivery periodtime for carrier to deliver the order.
The manufacturing lead times fluctuate between two (2) working days and three (3) weeks. In the event of stock shortage concerning the ordered product, an e-mail will be sent to the Customer to inform it of the manufacturing lead time.
Time of retractation
This right of retractation is exerted without penalty, except for the expenses of reference of the parcel which remains with the load of the Customer.
You have 7 clear days as from the reception of the order to return it and be completely refunded as soon as possible. With the expiry of this time, the right of retractation becomes irremediably null and void. The personalized products are not on the other hand refundable.

The product must be properly protected, in its original packaging (box or dust bag), in a perfect state of resale (undamaged, damaged or soiled) accompanied by any accessories, instructions and documentation. It must also be accompanied by the sales invoice in order to allow the identification of the Customer (order no, name, first name, address).
As part of this right of withdrawal, and for returned products that prove to be incomplete, damaged, soiled or unfit for resale, CARA will refuse to refund the said products, or to apply a discount to the amount of the refund.
Any parcel returned to the address provided by CARA and not including any element to identify the Buyer, especially the return number, can in no case be refunded. No claim on the part of the Buyer can be accepted.
If the above conditions are fulfilled, CARA will reimburse the Purchaser within fourteen (14) days from the date of receipt by CARA of the package.
The costs and the risks related to the forwarding are the responsibility of the Customer. Therefore, it is up to him to keep all the proofs of this return. CARA therefore recommends to return the products by sending followed by recommended type or Colissimo. If the product is lost by the carrier during this shipment, the Customer will be solely responsible and can not be reimbursed by CARA.
If the order were delivered in-outside European Union, the Customer must mention that it is about a return for nonconformity on the delivery form. The taxes of sale and taking out of bond will be the responsibility of the Customer and will be deduced from his refunding.
CARA reserves the right to refuse orders so too frequent returns are noted.
If, despite everything the care taken by CARA at the time of the preparation of the orders, one of the delivered Products were to prove to be defective, the Customer will have a seven (7) days deadline as from the day of delivery to turn over to his expenses the defective product for exchange or refunding. So that this request is treated as soon as possible, any defect will have to be notified with contact.gange@frqui will deliver an authorization of return then to him.
The parcel accompanied by the authorization of return (e-mail) will have to be turned over, sufficiently freed, at the address communicated by CARA.
Any claim formulated after the seven days deadline will be rejected and CARA will be released from any responsibility. If the above-mentioned conditions are met, CARA will carry out then the exchange or the refunding of the defective product and the shipping costs related to the product, within a period of thirty (30) days as from the date of reception by CARA of the parcel.
Shipping costs are calculated based on the delivery method chosen and the country of delivery indicated. These costs are payable by the Customer in addition to the price of the products purchased.
After Sales Service - Repairs
CARA After-Sales Service ("SAV") can only be requested for orders made on the GANGE website. Repair requests for GANGE products purchased in the shop or from any other distributor will not be processed by the After-Sales Service.
After-Sales Service conditions
The products distributed on the site are guaranteed six (6) months from the date of purchase.
Requests for compensation are handled within the scope of the after sales service, witch means :
- sewing problems
- tearing of the lining
- loss or breakage of metal parts (carabiners, rings, rivets, zips, etc.)
CARA can not be held responsible for problems related to the evolution or deterioration of the material used and made from vegetable fibers (discoloration, color transfer, stains, etc.) and can not undertake any repair of its restoration.
Requests for repairs made beyond six (6) months will be submitted for review by the SAV and invoiced according to the degree of intervention required, after agreement between the two parties.
- The Customer contacts the service by e-mail to email@example.com, by specifying his coordinates, his number of order, as well as the problem met, with photographs in support if necessary.
- After examination of the application, the SAV validates it if it meets the conditions mentioned above.
- Therefore the customer service informs the Customer of the procedure to follow.
The transport costs incurred by the return of the products are the sole responsibility of the Customer. CARA recommends to the Customer to return the products in Colissimo with delivery against signature, with a value of recommendation or complementary insurance guaranteeing, if necessary, the compensation of products up to their real market value in case of spoliation or loss of this merchandise. CARA can not be held responsible for delivery problems that occur during this return (loss, theft, address error, late delivery, damaged package, etc.).
CARA reserves the right to refuse to carry out repairs that are not within the scope of the services of the SAV or if it is found that the product has only known the wear of time, that it has been used or maintained improperly or has suffered accidental damage.
If the request is made within the warranty period, the SAV will, as far as possible, repair the defective product, free of charge, and send it back to the Customer within fifteen (15) working days following the date of receipt of the said product.
Once repaired, the product is returned to the Customer, shipped by CARA.
Are guaranteed, the manufacturing or blemishes announced to the reception of the product. Are excluded the damages from transport, the defects following a bad storage or a use nonin conformity.

In the event of late payment, in accordance with Article L 441-6 of the Commercial Code, an indemnity calculated on the basis of three times the legal interest rate in force and a lump sum indemnity for expenses will be payable. recovery of fifty (50) euros.
Failing payment on the due date, the recovery of our debt will be entrusted to a bailiff, the debt being increased at a flat rate of 15% of the amount of the debt as a penalty clause.
The parties agree that these General Conditions of Sale are subject to French law. Litigation will be the jurisdiction of the Commercial Court of Bordeaux 33000 (France) for a sale to a merchant and the Court of Instance for a sale to an individual.

In accordance with the laws in force, it is forbidden to the Customer, under penalty of prosecution, to reproduce in whole or in part the models that he has bought or that he has seen.
He is also prohibited from transmitting to third parties information allowing the total or partial reproduction of these models, in which case he would be guilty of complicity in the offense of counterfeiting.
The Customer agrees to inform the Seller in writing, without delay, of any act of infringement relating to the goods and / or models and / or brands of the Seller by third parties.
Photos and diagrams representing the products can not be reproduced.
